In Florida, it is against the law to
have illegal drugs, regardless of whether you use the drug, buy the
drug or sell the drug. For marijuana, it is a misdemeanor of the
first degree to have any amount of marijuana under twenty (20)
grams. That means that if convicted, you could face a maximum
criminal penalty which could include a year in jail. Certain other
drugs, like cocaine, are a felony to possess in any amount. But for
possession of twenty-eight (28) grams or more of cocaine, the charge
changes from possession of cocaine to trafficking in cocaine,
because based on that amount it is presumed that the drug is being
distributed to others.
For conviction of possession of amounts
of cocaine, there are required jail sentences ranging from a minimum
of three (3) years for possession of 28 grams to less than 200
grams, seven (7) years for possession of 200 grams to less than 400
grams, fifteen (15) years for possession of 400 grams to less than
150 kilograms, to life imprisonment for possession of 150 kilograms
or more of cocaine. The importation of 300 kilograms or more of
cocaine into Florida can be charged as a capital felony, punishable
by death.
